The DSS in Port Harcourt, the Rivers State capital, wanted to shoot Nyesom Wike the state governor; it all started in the early hours of Saturday when scores of DSS agents besieged the house of a Federal High Court judge at No. 35, Forces Avenue, old GRA. In what had been widely reported in various media platforms as “The illegal failed abduction of a High Court Judge”, Allegedly Led by Mr. Tosin Ajayi, Rivers State Director of the DSS; and Rivers State Police Commissioner, Mr. Francis Odesanya.
According to Mr. Simeon Nwakaudu, Governor Wike’s Special Assistant on Electronic Media, The governor had rushed to the scene of the incidence as the chief security officer of the state, having received security information on the illegal moves, minutes after the operation started at about 1am on Saturday morning. The security operatives blocked the entrance of the residence of the judge, claiming that they were acting on orders from above. As they dragged Governor Wike, insisting that they must be allowed to leave with the judge,” the DSS manhandled the Governor pushing him around and injuring his hand. A few of them cocked their rifles and threatened to shoot him.
This development is certainly a very bad one for Nigeria’s democracy. Nigeria is really in big trouble. More so, some of the big question as is being raised in the social media by close watchers includes,

Let us assume you caught a judge in the act of committing a crime on the street is the procedure not collect evidence, collect statements and whatever you do respect the principle that only a competent court can try them and that they are innocent until proven guilty.

1) Search Warrants are executed between 6:00 AM and 6:00 PM except on weekends.
2) Search Warrants are valid only if issued by a court of competent jurisdiction.
3) Search Warrants obtained in one State of Nigeria cannot be executed in another State excepted it is endorsed by a Magistrate or Judge equal in rank to the one that issued the Warrant.
4) Only two or three agencies in Nigeria are charged with the investigation of corruption cases namely the EFCC, the ICPC and the Nigeria Police.
5) Politically Exposed Persons (PEPs) and VIPs who do not constitute a flight risk are usually invited to appear before investigation Agencies.
6) The National Judicial Commission (NJC) is the only body empowered to sanction Judges and Justices found wanting in the discharge of their duties.
7) A current Governor is the Chief Security Officer of his State.
8) A current Governor enjoys immunity in terms of prosecution and the inviolability of his person.
9) The Judges in question have issued unfavorable judgments against the arresting Agency in the past, thus casting aspersions on the motive for their arrest.
ISSUES FOR DETERMINATION
1) did the arresting Agency actually procure an Arrest Warrant from a Court of competent jurisdiction?
2) Did the arresting Agency adhere to the rules governing the procurement and execution of a Search Warrant?
3) Did the arresting Agency exhaust the option of extending an invitation to the suspects before procuring the Arrest Warrant?
4) Did the arrested suspects at any time pose the risk of taking to flight?
5) Does the arresting Agency not have people at all the land, sea and air borders to prevent an escape of the suspects?
6) Did the arresting Agency at any time write a letter to the National Judicial Commission (NJC) highlighting the offences committed by the suspects and demanding their release for an interview?

Justice Liman narrowly missed been “stinged” by the DSS.
Justice Pingina insisted on due process in the Rivers State Governorship election tribunal sittings. He was removed midway during the sitting of the tribunal when APC saw that PDP was having the upper hand. The rest is history. Justice Pingina has just been “stinged” by DSS.
Justice Adeniyi Ademola, a brilliant judge, eldest grandson of a great former CJN of Nigeria, Adetokunbo Ademola was a judge who knew his onions. He came from a tradition. He could not be pushed around by powers that be. He ordered thrice that Dasuki be released. This did not go down well with Buhari and his government. They disobeyed his orders and concocted a new offence to rearrest Dasuki. Justice Adeniyi Ademola of the Federal High Court in Abuja also in May 26, 2016 dismissed Buhari’s preliminary objection in a suit filed by an Abuja-based legal practitioner Mr. Nnamdi Nwokocha-Ahaaiwe concerning Buhari certificate (WAEC). Justice Ademola has just been “stinged” by DSS
Justice Nnamdi Dimgba, a brilliant judge of the Federal High Court, Abuja was the judge who warned DSS to stop disobeying orders of court and told them not to come to his court again if they would not obey court orders. DSS was angry with this. They wanted to “sting” him but got a wrong name. However, they succeeded in breaking into his house and beating up his brother only for them to look into the paper they had on them to discover that it was not his name that was on the paper. That sure hurt them.
JSCs Ngwuta and Okoro sat on appeals that gave decisions against APC interest. They have just been “stinged” by DSS.
